Couple face weapons, conspiracy charges

May 05, 2009 | 02:34 PM Kathryn Smith, 50, the operator of the Just in Time Day Care Center, and her husband, David, 48, pleaded not guilty this week to two counts of third-degree criminal possession of a weapon; one count of fourth-degree criminal possession of weapon; and fifth-degree conspiracy. District Attorney Thomas Spota claims that detectives seized loaded guns and ammunition from a laundry bag in the basement of the licensed, residential center on Lantern Street, Huntington, and allege they were hiding the weapons for Kathryn's son Anthony Sands, an alleged Bloods street gang member, according the Suffolk DA's office.
The Smiths were released on their own recognizance. Their lawyer, J. Stewart Moore in Central Islip, did not return a call for comment. Kathryn Smith's license has been revoked and the center is closed.
The indictment also charges Sands and his girlfriend, of Central Islip, each with several counts of criminal weapons possession and conspiracy. Both are being represented by legal aides, the district attorney's spokesman, Robert Clifford, said.
