Councilman proposes building ban
Minimoratorium would protect study recommendations, Fiore-Rosenfeld says; public hearing set for Nov. 10

The Port Jefferson Station-Terryville Hamlet Study has been completed for one year, but some of its recommendations could become moot due to delays in implementation. Trying to prevent one such scenario — parcels slated for rezonings to be granted permits before Brookhaven can effectuate the zone changes — Councilman Steve Fiore-Rosenfeld (D-East Setauket) has introduced a local law to impose a 12-month moratorium limited to the 21 individual parcels identified for rezoning in the study.

The proposed moratorium will be the subject of a public hearing Tuesday, Nov. 10 at 6:30 pm at Town Hall in Farmingville.

According to the legal notice announcing the hearing, the moratorium "is necessary in order to provide time for the [Planning Department] to complete the environmental impact statement associated with implementation of the plan and study …" The parcels are located along Route 112, Route 347 and Bicycle Path, at the intersection of Old Town and Terryville roads, and at the former Lawrence Aviation Industries property, designated a superfund site and undergoing remediation by the Environmental Protection Agency.

Another public hearing is scheduled for the the next Town Board meeting on Nov. 24 to address the revocation of a building permit issued on part of the LAI property for a "fish farm," as Fiore-Rosenfeld described the application. He said the location was inappropriate for such a use since it proposes to build two large steel enclosures to create the ponds in which to raise the fish. According to the councilman, in order to create the ponds a large amount of clearing and regrading would be required since the land is hilly and at some places quite steep.
